Dine Cart Food Delivery Service - Terms and Conditions
1. Introduction
Welcome to Dine Cart, an online food delivery platform that connects customers, restaurant partners, and delivery partners. These Terms and Conditions (“Terms”) govern your use of the Dine Cart apps and services provided to customers, restaurant partners, and delivery partners.
By accessing or using the Dine Cart platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you should not use the app or the service.
2. Definitions
"Dine Cart" refers to the food delivery platform providing online services for customers, restaurant partners, and delivery partners.
"Customer" refers to individuals who use the Dine Cart customer app to place orders.
"Restaurant Partner" refers to businesses that list their food items and offer delivery services through Dine Cart.
"Delivery Partner" refers to individuals or entities who deliver food orders to customers via the Dine Cart platform.
3. Customer App - Terms and Conditions
3.1. Account Registration
To use the Dine Cart customer app, you must register an account with valid information, including but not limited to your name, contact number, email address, and delivery address. You are responsible for maintaining the confidentiality of your account information and ensuring it remains accurate.
3.2. Ordering Process
Customers can browse through restaurant menus, select items, and place orders.
All orders are subject to acceptance by the restaurant, and once confirmed, you will receive an order confirmation along with estimated delivery time.
You agree to pay the full amount for the order, including food items, taxes, delivery charges, and any applicable tips.
3.3. Payment
Payment can be made via debit/credit card, UPI, wallets, or cash on delivery.
The total payment includes food price, taxes, delivery fees, and any other charges.
3.4. Delivery
Dine Cart will assign a delivery partner to deliver your order.
Delivery times are estimates and may vary based on the restaurant, distance, and traffic conditions.
You must provide accurate delivery details, and ensure someone is available at the address to receive the order.
3.5. Cancellations and Refunds
Orders can be cancelled before they are processed by the restaurant. Once the order is in preparation, cancellation may not be possible.
In cases of food quality issues, incorrect orders, or delays, you may request a refund or replacement, which will be reviewed by Dine Cart.
3.6. Customer Responsibility
Ensure that you provide correct delivery information and check your order upon receipt.
Inform the restaurant about any food allergies or dietary restrictions.
You agree not to engage in fraudulent, abusive, or harmful behavior towards any partner or customer on the platform.
4. Restaurant Partner App - Terms and Conditions
4.1. Account Registration
To become a restaurant partner, you must register with Dine Cart, providing accurate information about your business, including food menu, pricing, delivery capabilities, and all relevant business licenses (e.g., FSSAI registration).
Dine Cart reserves the right to approve or reject restaurant partners based on compliance with the platform’s guidelines.
4.2. Order Fulfillment
Restaurant partners agree to promptly process orders received from customers, prepare food according to standards, and package it for delivery.
You agree to ensure that the food quality meets food safety and hygiene standards, including compliance with the Food Safety and Standards Authority of India (FSSAI) regulations.
4.3. Pricing and Fees
Dine Cart charges a commission on each order, which is agreed upon when signing the partnership contract.
Restaurants are responsible for setting menu prices and updating them on the platform.
4.4. Delivery
You can choose to use Dine Cart's delivery partners or manage your own delivery staff.
If you use Dine Cart delivery partners, you must ensure timely handover of orders to the assigned delivery partner.
4.5. Customer Interaction
You agree to handle customer complaints professionally and efficiently. Any disputes regarding food quality, delivery, or order fulfillment will be handled through Dine Cart customer support.
4.6. Termination
Dine Cart reserves the right to terminate your partnership if you violate these Terms or engage in misconduct such as food safety violations or failure to meet service standards.
5. Delivery Partner App - Terms and Conditions
5.1. Account Registration
Delivery partners must register on the Dine Cart app by providing accurate personal details, including valid identification and vehicle information.
You agree to maintain the confidentiality of your login credentials and will be responsible for any actions taken using your account.
5.2. Delivery Responsibilities
As a delivery partner, you will be responsible for picking up orders from restaurants and delivering them to customers in a safe and timely manner.
You agree to follow all traffic laws, regulations, and safety standards while delivering food.
5.3. Payments and Earnings
Delivery partners earn a commission for each successful delivery based on distance and order value.
Payments will be made on a weekly/monthly basis, depending on your agreement with Dine Cart.
5.4. Conduct and Behavior
You agree to maintain a professional demeanor at all times and refrain from any behavior that could damage Dine Cart’s reputation or customer relationships.
You must not engage in harassment or any form of abuse towards customers, restaurant partners, or Dine Cart staff.
5.5. Termination
Dine Cart reserves the right to suspend or terminate a delivery partner's account for breach of these Terms, failure to comply with delivery standards, or unethical behavior.
6. Privacy and Data Protection
Your use of Dine Cart services is subject to our Privacy Policy, which outlines how we collect, store, and protect your personal information. By using our platform, you consent to the collection and use of your information as described in the Privacy Policy.
7. Limitation of Liability
Dine Cart will not be liable for any indirect, incidental, or consequential damages, including delays, missed deliveries, or food-related issues caused by third-party actions.
Dine Cart is not responsible for any food allergies or dietary restrictions. You must confirm any dietary needs with the restaurant directly.
8. Dispute Resolution
Any disputes arising between Dine Cart and customers, restaurant partners, or delivery partners will be resolved through mediation or arbitration under Indian law, with the jurisdiction in Hyderabad, India.
9. Modification of Terms
Dine Cart reserves the right to modify or update these Terms at any time. Any changes will be communicated via email or in-app notifications. Your continued use of the services after such modifications will constitute acceptance of the new Terms.
10. Governing Law
These Terms will be governed by the laws of India, and any legal disputes will be subject to the jurisdiction of courts in Hyderabad, India.
